PRIVACY POLICY 

Applicable to interactions between Esquire Insurance, LLC on behalf of itself and its direct and indirect parents, subsidiaries, DBAs, and affiliates, and its and their respective successors and assigns (collectively, "Company"), and prospects, clients, website visitors, businesses, or other engagement from interested or uninterested individuals or entities (collectively "User"). 

Purpose of this Notice 

As provided by law, the Company is generally prohibited from sharing nonpublic personal information about users with a third party without providing privacy policies and practices describing the type of information collected about users and the categories of persons or entities to whom that information may be disclosed. Accordingly, the Company provides this document, which notifies users of the Company's privacy policies and practices. Furthermore, without obtaining a User's affirmative permission, the Company does not share the User's personal information with non-affiliated third parties for any purpose not specifically authorized by law. 

PRIVACY POLICIES AND PRACTICES 

Categories of Information Collected and Sources 

The Company collects nonpublic personal information about users from the following sources: 

User provided details verbal, written, or otherwise. 
User-submitted applications, forms, or digital submissions. 
Transactional User Data. 
Consumer reporting agencies. 
MVR (moving violations reports) Report. 
CLUE (claims loss underwriting exchange) Report. 
User or medical professional provided medical records. 

Unless expressly stated otherwise in an amended Privacy Policy Notice, no additional User information is collected. 

Persons From Whom Information is Collected 

The Company may collect nonpublic personal information from individuals other than those proposed for coverage. 

Information From Credit Reports or Investigative Consumer Reports 

If authorized, the Company may obtain information about Users from credit reports or other investigative consumer reports prepared by third parties at the User's request. Should that occur, Users have the right to request an interview in connection with preparing an investigative consumer report. Users are entitled to receive a copy of the consumer reports upon request. The information obtained from the reports may be retained by the third party and disclosed to others. User information collected by the Company in the course of general business practices, and as described above, may be disclosed to third parties without permission to the following types of institutions and for the reasons described. To a third party if the disclosure enables that party to perform a business, professional, or insurance function for the Company. To an insurance institution, agent, or credit reporting agency to detect or prevent criminal activity, fraud, or misrepresentation in connection with an insurance transaction. To an insurance institution, agent, or credit reporting agency of the Company or an entity the Company discloses information to perform a function in connection with an insurance transaction involving a User. To a medical care institution or medical professional to verify coverage or benefits, inform Users of a medical problem of which a User may not be aware, or conduct an audit that would enable the Company to verify treatment.To an insurance regulatory authority, law enforcement, or other governmental authority to protect, prevent, or prosecute fraud or illegal activities. To a group policyholder to report claims experience or conduct an audit of the Company's operations or services. To an actuarial or research organization to conduct actuarial or research studies. In addition to the circumstances listed, and unless otherwise directed by the use of the appropriate Opt-Out Form, the Company may disclose certain User information to third parties to market a product or service. Under no circumstances does the Company disclose any medical information, information relating to a claim for a benefit or a civil or criminal proceeding involving, or personal information relating to character, personal habits, mode of living, or general reputation for marketing purposes. 

Right to Access and Amend Personal Information 

Users have the right to request access to the personal information obtained by the Company. Users' rights include the right to know the source of the information and, if applicable, the identity of the persons or institutions that provided the information. Users have the right to know the types of institutions to which information was disclosed within two (2) years prior to the request. User rights also include the right to view and copy such information in person or request that a copy be sent by mail (charges may apply). User rights also include requesting corrections, amendments, or deleting any information in the Company's possession. 

Practices Regarding Information Confidentiality and Security 

The Company restricts access to nonpublic personal information to only employees who require access to such information to provide products or services. The Company maintains physical, electronic, and organizational safeguards to protect and secure User information.  

Internet Policies and Procedures 

The Company collects limited information about Users who visit areas of the Company's website(s) accessible to the public ("Public Areas"). This information is automatically collected on an aggregate basis ("Aggregate Information") to measure traffic on the website(s), including to the carrier. Aggregate Information is gathered using a "cookie" or small text file placed on the User's hard drive by the User's internet browser. The cookie allows the Company to track the number of hits or visits to various pages on the website(s), including to the carrier. When the Company's website(s) is accessed through a hyperlink on another website, the cookie will identify and track the Internet Protocol address ("IP") that linked the User to the website(s). If the User did not hyperlink to the Company's website from the most recently visited IP, then the Company will only identify the User's Internet Service Provider (e.g., google.com, bing.com, etc.). The cookie is used only during a single connection to the website(s) and the carrier website. It is not used to track user activity after leaving the website. It is permanently disabled when the User exits the website(s), and information about individual Users is not collected, saved or distributed to others by the Company. Aggregating data and other information gathered through voluntary user surveys and forms assist the Company in better understanding users' needs, improving the website, and enabling the Company to demonstrate to vendors and others information about the volume and nature of its website traffic. The website(s) and carrier contain hyperlinks to internet sites of Company members and other businesses and resources, and each internet site may have its own privacy and data collection policies and practices. The Company is not responsible for the privacy and data collection policies and practices of its members, other businesses and resources, or the content of their Internet sites. Users interested in Company members' privacy and data collection policies and practices or other businesses and resources should review their policies. The Company makes no representations of any kind about the internet sites of its members or other businesses and resources, and the Company disclaims all warranties and responsibilities of any kind, including, without limitation, warranties and responsibilities with respect to Company members' and other businesses' and resources' internet sites, content privacy and data collection policies and practices, and actions. This notice is being provided on behalf of the Company. 

Opt-Out Procedure 

By initiating a quote, contact request, form completion, or other engagement activity on the Company website(s) or platforms, Users authorize contact from the Company. Users are also added to 'opt-in' permission-marketing list. Users can 'opt-out' at any time. The Company does not transfer or sell the list to another party.
